East Palo Alto Rent Stabilization Board Rules and Regulations Committee meeting

The Rules and Regulations Committee will be holding the fourth in a series of meetings to work on the new rules and regulations this Friday, 13 August 2010, at 7:00 p.m.  We shall hold this Friday's meeting in the Community Room at City Hall, 2415 University Avenue.  We plan to meet for the next seven weeks  or until our work is done.
 
The focus for this Friday's meeting is Section 10 of the new Rent Stabilization Ordinance:  Annual General Adjustments of Maximum Allowable Rent.
 
We look forward to the participation of interested members of the public in this long and deliberate process to produce a set of new rules and regulations working with rent control expert Kenneth Baar that can ultimately be presented to the full Rent Stabilization Board for a public hearing and final review and adoption.
 
The new ordinance has many changes and updates for landlords and tenants.  Our task is to address the need for affordable homes, but also to allow our landlords to make a reasonable profit on their investment while maintaining properties as comfortable places to live.
 
I am attaching the meeting agenda for this Friday's fourth meeting of the Rules and Regulations Committee.
 
In addition I am attaching several documents that will be of use in studying the topic of annual general adjustments of maximum allowable rent:
 
1) Suggestions for New Rules and Regulations Volume One contains all written suggestions on all topics submitted as of July 28, 2010.  Pertinent to the topic are the June 24, 2010, email to City Attorney Vincent Ewing from Jeanne Merino of CLSEPA and Professor Juliet Brodie of Stanford Community Law Clinic, the July 7 Recommendations from Rent Board Member Robert Allen, the undated notes on Section 4 from Rent Board Chair Midge Dorn, the July 22 email "Rules and Regulations Required/Suggested by 2010 RSO (Measure H) by Rent Board Vice Chair Matthew Fremont,  the July 26 commentary on Matthew Fremont's July 22 email by Rent Board Chair Midge Dorn, and three emails from Youth United for Community Action (YUCA)  dated July 14, 15, and 21

4) Complete copy of current Rules and Regulations without annotations
 
5) Part 1 of current Rules and Regulations with annotations by me regarding language that could be incorporated into the new Rent Stabilization Ordinance
 
6) Part 2 of current Rules and Regulations with annotations by me regarding language that could be incorporated into the new Rent Stabilization Ordinance
 
If you have suggestions for rules and regulations to implement the principles of law in the new Rent Stabilization Ordinance that you believe are needed but have been overlooked, please share your suggestions.  Suggestions need to be in written form before they can be referred to Mr. Kenneth Baar, the attorney contracted by the City of East Palo Alto to write the final version of the new rules and regulations.  After our meeting this Friday, if you have not submitted your suggestions in writing, please send them to me as soon as possible.

Rent Stabilization Board Rules and Regulations Committee meeting schedule

Dear Friends,
 
Every Friday through at least 10 September the Rules and Regulations Committee of the East Palo Alto Rent Stabilization Board will be meeting between 7:00 p.m. and 9:00 p.m. to draft the new rules and regulations implementing the new Rent Stabilization Ordinance (Measure "H") passed by a 79.1% of all voters, including absentee voters.  Of those who actually cast their votes on Election Day 8 June 2010 an even more astounding 81% voted YES on Measure "H".
 
Our meetings are held in either the City Council Chambers or the adjoining Community Room at City Hall at 2415 University Avenue.
 
The Rules and Regulations Committee welcomes your participation in this project to create new rules and regulations to better protect the up to 12,000 residents of East Palo Alto who look to the Rent Stabilization Program for affordable and safe housing.  The ordeal of the past four years is not over, since Wells Fargo now owns all of the housing formerly owned by Page Mill Properties through foreclosure and the fate of the 1812 apartments and houses has not yet been decided.
 
But our task is to try to design rules and regulations implementing the new Rent Stabilization Ordinance that will give maximum protection to our families and friends who need affordable homes if East Palo Alto is to remain a haven for working people in the heart of Silicon Valley, where there is otherwise very little housing for working families.

A collective of partnering non-profit agencies, including Community Legal Services in East Palo Alto, Nuestra Casa, E4FC, International Institute, APILO, Immigrant Legal Resource Center, Parents Helping Parents, Renaissance Center, Eastside College Preparatory School, Opportunity Fund, Mission Asset Fund, California Center for Cooperative Development and Wages Cooperative, are hosting a free community event on August 14, 2010, from 9:00am - 3:30pm, entitled Nuestro Futuro es Seguro. The event is being sponsored by Bank of the West and Mi Pueblo.
 
The purpose of the event is to provide a forum for Latino community members, including the undocumented community, to obtain information regarding educational access and educational rights, current issues in immigration law, and useful information regarding creating economic opportunities and economic self-sustainability. The entire event will be conducted in Spanish.

CRIME STATISTICAL REPORT – FIRST SIX MONTHS OF 2010

OVERALL CRIME DOWN 11% - SHOOTINGS DOWN 44%

Since January 1, 2010, overall crime is down 11%. Assaults with a Firearm (Shootings) are down by 44% (this increase is amid a 29% decrease in shootings last year) and Assaults have decreased by 18%. Homicides are up by one (1) so far this year: there are 4 homicides this year compared to 3 last year. Sexual Assaults (Rapes) are also up this year from 6 to 10.

Robberies are down by 27% and Larcenies are down by 20%. Both of these categories saw increases last year. Burglaries are up by 4%, however, which continues the upward trend experienced last year. Auto Thefts are also up by 15% this year (this increase is amid a 40% reduction last year).

 Next Steps

The Police Department will continue its implementation of Operation Ceasefire. This strategy uses crime-intelligence to identify those involved in gangs, drugs and violence, and then partners law enforcement with the community to sit down with these individuals (also known as “call-ins”) and offer them services and alternatives to stop their destructive behavior. If these individuals fail take advantage of the services offered and continue to victimize our community, the Police Department then utilizes all available resources at the local, county, state, and federal levels to hold them accountable.

 

Over the next six months, the Department’s newly formed Violence Interdiction Team (VIT) will work with the community and our law enforcement partners to conduct several “call-ins”.

 

Over the next six months, the Police Department will also strengthen its Police Activities League (PAL) and increase the level and types of activities provided by the program. This includes launching the second Graffiti Arts Project (GAP), in partnership with the Mural, Music and Arts Project (MMAP). GAP teaches at-risk youth how to use their talents to transform graffiti into art that compliments the community. The GAP program will start in August.

 

The Police Chaplains will work with our youth over the summer to launch a comprehensive and aggressive anti-violence campaign and conduct a Youth Summit in early September.

The Police Department will restore the School Resource Officer (SRO) at the beginning of the school year to work closely with the school district to increase campus safety. The Department has partnered with the East Palo Alto Youth Court and the Ravenswood and Sequoia School Districts to increase our focus on truancy and curfews – both contribute to decreasing school attendance and increasing crime rates. By working with the Youth Court, the Police Department can intervene and hold our youth (and their families accountable) without entering them into the criminal justice system. For more information about the East Palo Alto Youth Court, please watch the next episode of “Make the Call”which will air in late July on the Media Center (www.communitymediacenter.net).

 

In October, the Police Department will launch its annual Operation 4th Quarter in attempts to stop the increase of violence that historically occurs during these months.

The Police Department is working closely with the California Department of Corrections and Rehabilitation (CDCR) to obtain another 3-year contract for the East Palo Alto Parole Reentry Program. The first reentry program was extremely successful and now serves as a national model. The return-to-custody rate for parolees served in this program was approximately 20% - this is much lower than the state average of 60%. The new contract is tentatively scheduled to start October 1, 2010

About the Challenge...
The Drive Less Challenge is a friendly social competition to reduce solo car trips. The mission is to change driving behavior by motivating people to act in the context of their social networks, spurred by positive feedback.  After a successful pilot in 2009 in Menlo Park, the Drive Less Challenge is expanding in 2010 to include the neighboring communities of Palo Alto, Mountain View, and Burlingame (and EPA I hope!)

The Challenge provides a web-based, game-like contest that allows participants to log their daily, non-car trips (walk, bus, bike, etc.) and compete within their communities - friends, neighborhood, school, workplace, faith communities. It runs for 2 weeks starting Earth Day, April 22, 2010.  There are many ways to win, to encourage behavior change. Participants also share their stories about alternatives to driving as inspiration and role model.  Find out more at  http://www.drivelesschallenge.com

Why EPA...?
The DLC is a great way for our mid-Peninsula Cities to work together on a grassroots way to reduce one of the biggest generators of green house gasses in our community, car travel. Moreover, as cities on the bay we have much higher risks of flooding as sea levels rise and driving less is something all citizens can do to help right now.

Let us know if you would like to help....
We have a Google Group to coordinate and are developing a kind of tool kit (model invitation letters, blurbs, posters, press release, articles, etc.) to help volunteers to coordinate for their city and do outreach to sponsors, press and community groups (schools, churches, etc), to generate participation.  We are in the midst of fundraising, online system development and communications planning now.

Dearest CDDW Friends & Family,

Much progress has been made since, with heavy hearts, we announced the passing of our beloved brother, uncle, teacher and friend, Jean Louis Pangou Mbemba. Mbemba, as he was affectionately known, lived in San Francisco for close to 30 years and was the consummate artist. Born in the Republic of Congo on September 30, 1949, Mbemba was blessed with astounding talents in both traditional and popular Congolese art forms, including music, dance and theater. These talents led him all over the world, to the US in the late seventies, and to California, where he then settled in the early 1980s.
 
Though a treasured member of the SF Bay Area Congolese community, Mbemba has no immediate family in the United States. Therefore, it has fallen upon us, his extended family and community, to begin the process of ensuring that he receives a farewell befitting a man of such kindness and virtue. Mbemba's younger brother, Jean Pierre, who resides in Congo, has plans to come to California to represent his family and see that their wishes are carried out.
 
While his brother is navigating the legal red tape required to travel from Congo to the United States, we, as Mbemba's long time friends and extended family, have established a memorial account to help support his immediate family carry out his wish to be buried at home in the Republic of Congo. Dear Family Members and Friends,

I am writing to ask you to contact the Senators and Representatives of
your state to ask them to support the DREAM Act. This request is for
everyone, especially those of you who live in UTAH, HAWAII, ALASKA,
OREGON, WASHINGTON, TEXAS, AND IDAHO.

The DREAM Act is proposed law that would allow young men and women who
came to the United States when they were children to legalize their
immigration status.

If the DREAM Act passes, then youth who meet the following criteria will
be eligible for a temporary green card:

* Older than 12 on the date the DREAM Act passes
* Came to the U.S.A. before age 16
* In the U.S.A. for at least five years continuously
* Still younger than 35
* Graduated from high school or earned a general equivalency degree
(G.E.D.)

Each year about 65,00 youth who live in the United States, including
some Pacific Islanders, are blocked from pursuing their dreams because
they are undocumented, even though they have spent nearly all their
lives here. This is a tragic situation and must be fixed.

An earlier version of the DREAM Act almost passed in October 2007.   Now
is the time. Please do not let this opportunity pass by. Contact your
Senators and Representatives now and spread the word to your friends and
family.
